This Privacy Policy describes how SnapNHD, LLC, a California limited liability company ("Company", "we", or "us") collects, uses, and discloses information that may be used, directly or indirectly, to identify you ("Personal Information") through offline and online interactions with you. This policy also applies to information that we may obtain from a third party about you. In all cases, this policy applies only when the Company is acting as a controller or owner of the information in question. When we receive or process information on behalf of one of our clients as their third party service provider, the processing of that information is governed by our client's privacy policy.

This Privacy Policy does not apply to information collected by third parties through any other means, including any third party or any application or content (including advertising) that may link to, or be accessible from or on the Website.

INFORMATION WE COLLECT ABOUT YOU

Depending on the services you use, the following are the categories and specific types of Personal Information that we may collect, or have collected in the preceding twelve months:

  • Contact Information/Identifiers, including name, email address, postal address, phone number, username, business contact information, or other similar identifiers and account information.
  • Information Specific to the Services, in certain instances, such as invoices, business and commercial communications, order status and history.
  • Device Information and Other Unique Identifiers, device identifier, internet protocol (IP) address, or similar unique identifiers.
  • Internet or Other Network Activity, including browsing or search history, and information regarding your interactions with our websites, mobile applications, emails, or advertisements.

To the extent that you are a current or former employee, contractor, or other personnel (collectively, "employee"), or an applicant, SnapNHD may also collect the following information about you:

  • Contact information (g., name, sex , age, date of birth, email address, mailing address, telephone number, social media profiles, and in certain instances, identification documents such as residency or work permits, SSN, other taxpayer/government identification number, as well as emergency contact information);
  • Professional and employment-related information (g., professional qualifications, prior employment history, education history, references);
  • Interview information (g., notes collected by interviewers or other professional assessment information);
  • Pre-employment screening (g., criminal background check, as permitted by law);
  • Organizational data including work contact details (g., address, email, phone number, position/title, job function, employee ID, work eligibility information);
  • Contract and compensation data (g., bonus information);
  • Employment-related information (g., benefits information, performance data);
  • Compliance and disciplinary information; and
  • Sensitive Personal Information (where permitted and in accordance with applicable law), which may include biometric data, SSN, driver's license number, racial or ethnic origin, trade union membership, health and medical information, drug screening results where applicable, sexual orientation, and/or criminal history may also qualify as Personal Information, as well as the contents of certain email or other communications made using SnapNHD equipment.

HOW WE COLLECT INFORMATION ABOUT YOU

We collect several types of information from and about you in both online and offline contexts.

We collect this information directly from you when you provide it to us or automatically as you navigate through the Website. For example, when you create an account, we may request your name, email, phone number, company, and zip code. When you place an order, we will request credit card and address information. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Website or transmitted to other users of the Website or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the Personal Information you provide to us. You may have the right to opt in, object to, or opt out of certain uses of your Personal Information. Where you have consented to the processing of your Personal Information, you may withdraw that consent at any time by contacting us as described below.

If you do not want us to use your email address to promote our own or third parties' products or services, or otherwise receive an unwanted email from us, you can opt out by following the instructions in the email or emailing us stating you request at hello@snapnhd.com. Please note, that certain transaction-related emails from services or products you have requested may still continue after you opt-out. We may also continue to send certain non-promotional communications after you opt-out (e.g. communications when we update out Terms of Use or this Privacy Policy).

INDIVIDUAL RIGHTS IN PERSONAL INFORMATION

Your Rights

You may have certain rights regarding your Personal Information.  The rights available to you depend on our reason for processing your Personal Information and the requirements of applicable law (i.e., your rights will vary depending on your state of residence including, for example, Delaware). Specifically, you may have the following rights:

  • Right to access:You may have the right to obtain from us confirmation as to whether Personal Information concerning you is being processed, and, where that is the case, to request access to the Personal Information.  You may also have the right to request a list of third parties that have received Personal Data from us, depending on where you are located.
  • Right to correct inaccurate information:You may have the right to request that we correct any Personal Information about you that is inaccurate.  Depending on the purpose of the processing, you also have the right to request that we complete the Personal Information we hold about you where you believe it is incomplete, including by means of providing a supplementary statement.
  • Right to Deletion:You may have the right to request that we erase your Personal Information, under certain conditions.
  • Right to restrict processing:You may have the right to request that we restrict the processing of your Personal Information, under certain conditions. In such case, the respective data will be marked and may only be processed by us for certain purposes.
  • Right to object to processing:You may have the right to object to our processing of your Personal Information, under certain conditions, and we can be required to no longer process your Personal Information.  Such right to object may especially apply if we collect and process your Personal Information through automated decision making, such as profiling, to better understand your interests in our products and services or for direct marketing.  If you have a right to object and you exercise this right, your Personal Information will no longer be processed by us for such purposes.
  • Right to data portability:You may have the right to request that we transfer the Personal Information we have collected about you to another organization, or directly to you, in a structured, commonly used, and machine-readable format, under certain conditions.
  • Right to withdraw consent:Where we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.
  • Right to know what Personal Information is sold or shared and to whom, and right to prohibit the sale or sharing of Personal Information: We do not and have not in the preceding 12 months, sold your Personal Information.
  • Right to limit the use and disclosure of sensitive Personal Information: We will only use sensitive or special Personal Information as needed for the purposes for which it was collected. If this changes, we will notify you, and you may have the right to restrict such additional uses.
  • Right of non-discrimination/retaliation: We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy, nor do we retaliate against individuals who exercise these rights.

Please note that many of the above rights are subject to exceptions and limitations.  Your rights and our responses will vary based on the circumstances of the request.  If you choose to assert any of these rights under applicable law, we will respond within the time period prescribed by such law.

If you are located in certain jurisdictions, a person authorized to act on your behalf may make a verifiable request related to your Personal Information.  If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf in accordance with applicable law.

In most circumstances, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it.  We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

ACCESSING AND CORRECTING YOUR USER CONTRIBUTIONS AND ACCOUNT INFORMATION DIRECTLY

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send us an email at hello@snapnhd.com to request access to, correct or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or may have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Use.

STORING YOUR INFORMATION

We will keep your Personal Information for as long as we have a relationship with you. Once our relationship with you has come to an end, we will retain your Personal Information for a period of time that enables us to:

  • Maintain business records for analysis and/or audit purposes;
  • Comply with record retention requirements;
  • Defend or bring any existing or potential legal claims;
  • Deal with any queries or complaints you may have; and
  • Comply with any other relevant laws and regulations.

We will exercise our best efforts to delete or deidentify your Personal Information when it is no longer required for these purposes. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any unnecessary processing or use of the information.

Data Transfers

We are headquartered in the United States and we may have operations, entities, and service providers both in the United States and throughout the world.  As such, we and our service providers may transfer your Personal Information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction.  We will take steps to ensure that your Personal Information receives an adequate level of protection in the jurisdictions in which we process it. 

DATA SECURITY

The Company maintains commercially reasonable physical, electronic and procedural safeguards in compliance with any applicable state and federal regulations to guard nonpublic personal information. Despite these protections, where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website. Unfortunately, the transmission of information via the internet is not completely secure. CHILDREN
